L.A. County Must Pay Home Care Providers More for Overtime (1)

Los Angeles County isn’t immune from a collective action by home care providers alleging they’re owed overtime pay, the Ninth Circuit affirmed Aug. 22.

The 11th Amendment’s grant of immunity to states doesn’t extend to counties, Judge Mark J. Bennett wrote for the U.S. Court of Appeals for the Ninth Circuit.

The ruling is likely to increase costs for the county and the state of California without bringing any benefit to home care recipients, according to representatives of the home care industry.
