Kroger-Owned Grocery Chain Sued By Managers For Unpaid Overtime

Mariano’s, an Illinois-based grocery chain owned by Kroger Co., was hit with a federal lawsuit brought by nearly 25 managers in Chicago who claim they were misclassified as administrative employees exempt from overtime pay.

The employees, who worked as personal service managers, were previously included in a Fair Labor Standards Act collective action that was decertified in August. Their new complaint, filed Oct. 8 in the U.S. District Court for the Northern District of Illinois, asserts individual claims under the FLSA, Illinois wage law, and Chicago wage ordinance.
