Kohl’s Assistant Store Manager Alleges N.Y. Overtime Violations

Kohl’s violated New York wage law by classifying its assistant store managers as executives exempt from overtime rules, according to a proposed class action filed Wednesday in a White Plains federal court.

The department store regularly requires these managers to perform non-managerial duties that take up more than 50% of their workday, supervises their work, and only pays them “a little more” than its non-exempt hourly staff, the lawsuit claims.

Jenna Graziano sued Kohl’s Department Stores Inc. and Kohl’s Corp. under New York labor law, seeking to represent “more than 100" other assistant store managers (ASMs) across the state.
