Kaiser Foundation Hospitals is free for now of a San Francisco nurse’s allegations that she faced retaliation and a hostile work environment after her safety-related advocacy.
Federal labor law likely preempts many of the worker’s state-law claims, but the complaint doesn’t provide enough detail to tell for sure, the US District Court for the Northern District of California said, dismissing those allegations with leave to amend. But the nurse can’t try again on her workplace safety claims because the regulations Kaiser allegedly violated don’t provide an avenue for private lawsuits, the Tuesday order said.
