Justices Won’t Take Up Challenge to Care Worker Union Power

The U.S. Supreme Court won’t consider whether unions can represent government-subsidized home care workers who aren’t union members.

The justices May 13 declined to take up a First Amendment challenge to a Service Employees International Union affiliate’s authority to speak for all Minnesota home care workers paid through a Medicaid program, including nonmembers. A group of workers, represented by the conservative National Right to Work Legal Defense Foundation, sought review of an appeals court decision dismissing their lawsuit.
