A welding inspector who says Killick Group LLC misclassified him as an independent contractor when he was really its employee failed to convince the US Supreme Court Monday to review how the Fifth Circuit handled his case.
The worker said the intermediate appellate court went too far when it looked beyond the district judge’s ruling that his claim of self-employment during a past legal proceeding barred his wage allegations and determined he wasn’t misclassified regardless.
