The US Supreme Court declined to take up a case seeking clarity on whether baked goods delivery drivers who formed individual corporate entities fall under a federal law exempting transportation workers from mandatory arbitration requirements.
The justices on Monday rejected a petition from Baltimore-based Schmidt Baking Co. and Schmidt Baking Distribution LLC to review a US Court of Appeals for the Second Circuit’s order allowing drivers Nathaniel Silva and Phil Rothkugel to invoke the Federal Arbitration Act’s exemption to keep their wage claims in court.
