Justices Question Courts’ Authority Over Arbitration Awards (1)

A potential majority of US Supreme Court justices appeared to agree that federal courts that initially had jurisdiction to hear a case before staying it for arbitration are still authorized to confirm or vacate the resulting arbitration award.

At least five justices during oral arguments Monday expressed skepticism of Adrian Jules’ arguments against that process. Jules petitioned to overturn a US Court of Appeals for the Second Circuit order allowing a district court to enforce an arbitrator’s dismissal of his employment discrimination claims against hotelier André Balazs, in addition to sanctions imposed on him and his attorney for “beyond unusual” ...
