Justices Pass on FMC Technologies Worker’s Overtime Challenge

A former FMC Technologies Inc. installation engineer excluded from overtime protections under an exemption for professionals lost the chance to argue the carveout doesn’t apply after the US Supreme Court on Tuesday declined to consider his case.

The worker asked the high court to weigh in on whether he was actually paid on the salary basis set out in the Fair Labor Standards Act’s “learned professional” exemption when he also earned non-guaranteed bonuses equal to more than half of his guaranteed weekly pay.
