Justices Deny Review of Los Angeles Schools’ Vaccine Mandate

The US Supreme Court declined to examine whether a smallpox-era precedent supports the constitutionality of the Los Angeles Unified School District’s 2021 policy requiring its employees to be vaccinated against Covid-19.

The justices on Monday denied a petition from a group of employers, who challenged the now-rescinded mandate, to review a divided en banc US Court of Appeals for the Ninth Circuit decision that the school district didn’t violate their constitutional due process rights. The challengers maintained that they have a “fundamental right to bodily integrity in refusing medical treatment” and that the circuit ignored their individual liberty interest.
