Justices Decline to Review Challenge To OFCCP’s Section 503 Disability Rules

The U.S. Supreme Court June 15 declined to review a federal appeals court decision upholding Labor Department regulations pertaining to federal contractors’ affirmative action obligations toward individuals with disabilities (Associated Builders & Contractors, Inc. v. Shiu, U.S., 14-1111, cert. denied 6/15/15).

Last December, the U.S. Court of Appeals for the District of Columbia Circuit rejected the Associated Builders & Contractors Inc.'s challenge to final rules issued by the DOL’s Office of Federal Contract Compliance Programs under Section 503 of the Rehabilitation Act (773 F.3d 257, 30 AD Cases 1793 (D.C.
