Justices Decline Fight Over Forcing Whistleblower to Arbitration

The U.S. Supreme Court on Monday declined to consider whether a federal whistleblower statute bars forced arbitration in the case of a Department of Veterans Affairs contractor who said he was fired in retaliation for calling attention to his employer’s alleged bribery scheme.

The U.S. Court of Appeals for the Fifth Circuit said in a matter of first impression in 2020 that the Federal Arbitration Act couldn’t be overridden by the rule that carves out a right to a jury trial for whistleblowers.
