Judges’ Union Appealed Decertification Too Soon, Court Says (1)

A union representing some 500 immigration judges acted prematurely in seeking judicial review to undo a Republican-controlled federal labor panel’s decertification order, a federal appeals court ruled.

The National Association of Immigration Judges’ bid to block the Federal Labor Relations Authority’s November 2020 order finding that its members are managers and therefore ineligible for collective bargaining wasn’t ripe for review because the agency hasn’t yet heard the union’s motion for reconsideration, the US Court of Appeals for the District of Columbia Circuit ruled Friday.
