Judge Tosses Out Freelancer Lawsuit Challenging Gig Worker Rule

A Tennessee-based federal judge has dismissed a lawsuit against a US Department of Labor rule that makes it harder for employers to label their workers as independent contractors, in a win for the agency.

District Judge Waverly D. Crenshaw Jr for the Middle District of Tennessee March 11 adopted a judge’s recommendation that the case be tossed because the freelancers suing over the rule failed to establish standing.

“The Court finds that Plaintiffs do not have Article III standing to challenge the 2024 Rule, and it will therefore dismiss this case without prejudice for lack of subject matter jurisdiction,” Crenshaw ...
