Judge Reverses H-1B Visa Denial for Market Research Analyst (1)

A Boston commercial real estate developer’s petition for an H-1B visa should have been granted, as the market research analyst position qualified for the specialty occupation visa, a Massachusetts federal court ruled.

U.S. Citizenship and Immigration Services’ decision to deny the Drew Company’s petition for Ukrainian national Oleksii Vekla “constitutes an abuse of discretion,” Judge Rya W. Zobel of the U.S. District Court for the District of Massachusetts, said in an opinion issued Wednesday reversing the agency’s decision.
