A Michigan judge threw out a lawsuit challenging the state’s ban on having Medicaid cover abortions, ruling that the nonprofit that brought the case doesn’t have standing.
Michigan Court of Claims Chief Judge Brock A. Swartzle, in a July 3 summary disposition opinion posted Tuesday on the court’s website, rejected all of YWCA Kalamazoo’s standing arguments. This includes authority to sue as taxpayers, the argument that it must pay for abortion care that would otherwise be covered by Medicaid, and that it may seek a ruling that lays out its rights on the issue.
