Jones Lang LaSalle Prevails in Benefit Fund Contribution Appeal

Jones Lang LaSalle Americas Inc. on Friday convinced a divided Third Circuit panel that it doesn’t owe higher benefit fund contributions based on the higher pay rate employees receive when working overtime.

The company’s collective bargaining agreements treat overtime pay as a premium wage rate that doesn’t affect an employee’s “hours paid” for purposes of determining the contributions owed to benefit funds covering unionized workers, the US Court of Appeals for the Third Circuit said.
