The Labor Department may issue new guidance or rulemaking to clarify the Trump administration’s views on joint employer liability and employee versus independent contractor status, the agency’s chief legal officer said at a law conference June 8.
“I think that this is something they are considering, among many other areas,” DOL Solicitor Kate O’Scannlain said.
She didn’t specify whether discussions have involved a new regulation or subregulatory guidance. The latter can be published faster because public input is not required.
