JBS Denied Dismissal of EEOC’s Bias Claims for Muslim Workers

JBS USA LLC must face the EEOC’s race, national origin, and religious bias and job retaliation claims on behalf of Black Somali Muslim workers at Greeley, Colo., meatpacking plant who were allegedly denied prayer breaks and otherwise mistreated, the U.S. District Court for the District of Colorado ruled.

The decision comes in the second phase of the Equal Employment Opportunity Commission’s 2010 lawsuit involving the facility. Judge Philip A. Brimmer dismissed the EEOC’s Phase I pattern-or-practice claims in September 2018 following a 16-day trial in August 2017.
