Jackson Hewitt Subsidiary Can Make Worker Arbitrate in Wage Row

A Jackson Hewitt subsidiary can force a tax preparer to take her wage-and-hour allegations, filed on behalf of a proposed class, to arbitration, a federal magistrate judge in California said.

The worker formed an arbitration agreement with the subsidiary Tax Services of America Inc., the US District Court for the Northern District of California said. The arbitration pact includes an enforceable delegation provision, so it’s up to the arbitrator to resolve remaining questions about whether the worker must arbitrate her wage claims, the Wednesday order said.
