A group of tax preparers who say a Jackson Hewitt Inc. customer gift-card program cheated them out of earned commissions failed to show common interests that predominate over the individual interests, the District of New Jersey ruled, declining to certify a nationwide class against the company and two related entities.
Wanda Mardis and the other named plaintiffs sought to represent all tax preparers employed by Tax Services of America Inc. between the 2013-2014 and 2016-2017 tax seasons whose pay was lowered by the promotional program, the court said.
