The owner of 26 Jack in the Box franchises in Northern California is appealing penalties of $903,085 for failure to pay overtime to 40 allegedly misclassified managers.
Nor-Cal Venture Group Inc. misclassified the managers as exempt and required them to work a minimum of 45 hours a week without overtime pay, the California Labor Commissioner’s Office said in an Aug. 9 statement.
Under state law, managers who spend less than half their work time on managerial duties must be paid overtime.
