The US Interior Department reduced a former employee’s $1.7 million age bias win after the Ninth Circuit for a second time ruled a lower court miscalculated how much the worker deserves in front pay.
A district judge twice awarded the ex-Bureau of Reclamation realty specialist front pay for an 11-year period. But the lower court abused its discretion when it found the worker wasn’t likely to land a similar federal job, the US Court of Appeals for the Ninth Circuit said in an unpublished opinion Wednesday, remanding the case with specific instructions on how to calculate front pay.
