Instacart is facing allegations that it violated New York labor law by misclassifying delivery drivers and shoppers as independent contractors instead of employees, in a new lawsuit filed in a federal court in Manhattan.
The proposed class action was brought by Joseph Chambers, who worked as an Instacart shopper and delivery driver in Williamsville, N.Y., on behalf of similarly situated workers.
Instacart’s misclassification has unlawfully deprived these workers of minimum and overtime wages, and forced them to pay for necessary work-related expenses like vehicle maintenance, gas, insurance, and phone costs, the complaint says.
