Insomnia Cookies LLC can move forward with most counterclaims against a manager who allegedly took financial records without permission before joining an overtime lawsuit.
The cookies chain plausibly alleged the manager misappropriated its protectable trade secrets, breached a nondisclosure agreement, and tampered with its computer data, the US District Court for the Eastern District of Missouri said. But Insomnia can’t pursue a claim for misappropriating confidential information, the Wednesday opinion said.
