Industry Wants NLRB to Set Worker Status Test by Regulation (1)

A broad coalition of industry groups asked the National Labor Relations Board to create a regulation to lock in place a business-friendly test for determining independent contractor status, giving the White House a chance to set that legal standard.

The NLRB’s traditional method for establishing legal frameworks in rulings has led to continual changes to its employment classification test, the most recent of which clashes with a key federal appeals court’s view of the law, business advocacy groups said in their petition filed Wednesday.
