A coalition of business groups led by the US Chamber of Commerce can intervene in a union’s case challenging the scope of the National Labor Relations Board’s joint employment rule as part of an effort to get it dismissed, a federal appeals court ruled.
The coalition met the bar to participate and thus can file its motion to dismiss the case for lack of jurisdiction, the US Court of Appeals for the District of Columbia Circuit held Thursday in an unsigned decision.
