Indian CEO Should Get Second Shot at Visa Extension, Court Says

An India-based information technology company’s petition for an L-1 visa extension shouldn’t have been denied because it provided adequate proof that the chief executive officer of its U.S. branch was qualified, a New Jersey federal judge ruled.

The U.S. Citizenship and Immigration Services decision to deny Sequretek Inc.'s petition for Anand Mahendrabhai Naik was “arbitrary and capricious” because it failed to consider all of the evidence or fully explain its rationale, Judge Kevin McNulty of the U.S. District Court for the District of New Jersey ruled Wednesday.
