Immigration Judges Fail to Block DOJ Memo in Free Speech Dispute

A U.S. judge denied an immigration judges’ union motion for an order blocking enforcement of a Justice Department memo that the union said unlawfully restricts members from speaking publicly, in their personal capacities, about immigration law or policy.

“A preliminary injunction is an extraordinary remedy” that may only be granted when the plaintiffs show they’re likely to prevail on the merits, Judge Liam O’Grady of the U.S. District Court for the Eastern District of Virginia said in a decision issued Thursday.
