Kyndryl Inc. defeated two of a worker’s three theories that the company retaliated against him when it went through with a plan to lay him off, a federal judge in Missouri said.
The ex-employee didn’t sufficiently allege that the IT infrastructure services company’s failure to investigate when he complained about being selected for the layoff based on his age counts as retaliation, the US District Court for the Western District of Missouri said. He also failed to plead that his already-planned termination was retaliation for complaining, the Thursday opinion said.
