IBM Arbitration Win Upheld on Age Bias Claim Filed One Day Late

International Business Machines Corp. saw its arbitration win affirmed on a former employee’s age discrimination claim, after the Eleventh Circuit affirmed Thursday that the arbitrator correctly rejected the worker’s late submission.

Tanya Smith appealed to the US Court of Appeals for the Eleventh Circuit after a district court confirmed the company’s arbitration award. The arbitrator concluded that Smith sent her arbitration demand to the technology giant one day too late under the plain terms of the separation agreement she signed when she was terminated in a 2020 reduction in force, at age 54.
