Huntington Ingalls Workers’ Comp Case Evades Supreme Court Look

The US Supreme Court declined to review a dispute seeking to clear up a circuit split over whether maritime workers injured on the job can pursue a state-law tort claim for damages against their employer after eschewing a federal workers’ compensation law.

The justices on Monday rejected shipbuilding giant Huntington Ingalls Inc.‘s petition to overturn a US Court of Appeals for the Fifth Circuit ruling that the Longshore and Harbor Workers’ Compensation Act doesn’t bar employee Ronald Barrosse from suing for asbestos exposure under Louisiana tort law.

The LHWCA provides a no-fault compensation remedy to injured maritime workers.
