Houston Builder Asks D.C. Circuit for Second Chance on Citation

A Houston-based construction company is asking a federal appeals court to allow it to fight a workplace safety violation after the company missed the deadline to do so.

When the Occupational Safety and Health Administration cited the company for an other-than-serious violation, the superintendent at David E. Harvey Builders, Inc.'s Doraville, Ga., construction site reported Feb. 14 that the company’s main office address was in Bethesda, Md.

OSHA later sent the citation to that office, but Scott Oliver, the company’s corporate safety director, is located at Harvey’s Houston headquarters. He became aware April 7 of the violation of 29 C.F.R. ...
