House GOP Members Plan on Backing Challenge of Shot-or-Test Rule

Republican House members are urging their colleagues to sign on to a friend-of-the-court brief opposing the Biden administration’s Covid-19 shot-or-test rule for large employers, according to a letter obtained by Bloomberg Law.

• The Occupational Safety and Health Administration’s emergency standard has been stayed since Nov. 6, with a federal appeals court in Cincinnati poised to hear consolidated challenges to the regulation.
• Republican Reps. Rick Allen (R-Ga.), Elise Stefanik (R-N.Y.), Jim Banks (R-Ind.), and Virginia Foxx (R-N.C.) signed the letter, which was circulated Dec. 8.
