Hotel Bel-Air’s Refusal to Rehire Workers Again Found Illegal

A Los Angeles hotel illegally refused to rehire 152 unionized workers after renovations, a federal appeals court ruled, affirming a National Labor Relations Board decision.

The NLRB in 2021 found that Kava Holdings LLC, which does business as Hotel Bel-Air, used the layoffs as an excuse to shirk its duties to bargain with the union. A three-judge panel at the US Court of Appeals for the Ninth Circuit upheld that order Tuesday.

Judges Jennifer Sung, Ryan Nelson, and Danielle Forrest unanimously tossed aside Kava’s arguments that the board improperly found anti-union animus, saying there was “substantial evidence” supporting the decision. ...
