A Florida hospital system blocked nurses from pursuing as a group allegations that it made them pay $5,000 if they left within two years of completing an in-house fellowship program.
The plaintiff, who left her job with NCH Healthcare System Inc. and Naples Community Hospital Inc. just shy of the one-year mark, isn’t similarly situated to the four other nurses who opted to join her Fair Labor Standards Act suit, the US District Court for the Middle District of Florida said. The workers’ “circumstances differ significantly,” according to the Monday opinion decertifying the collective.
