A home health company remains on the hook for more than $7 million after a federal appeals court on Friday rejected its call to toss the US Labor Department’s back pay and liquidated damages victory.
The lower court didn’t err when it determined Prestige Home Care Agency must compensate workers for time spent traveling between its office and client sites, the US Court of Appeals for the Third Circuit said.
The Philadelphia-based healthcare provider unsuccessfully urged the appellate panel to reverse its loss based on last year’s US Supreme Court decision erasing a decades-old agency deference rule.
