Home Health Aides Get Class Status in N.Y. Overtime, Notice Suit

A New York federal judge ruled Wednesday that more than 165 home health aides may proceed as a certified class on state-law claims that their employer cheated them out of overtime pay and didn’t provide wage notices in their primary languages.

The evidence shows that the employees were all victimized by the same unlawful policies and practices, and they can prove their claims using common evidence like payroll records and declarations, Judge Kiyo A. Matsumoto of the U.S. District Court for the Eastern District of New York said.
