Home Depot Gets Workers’ Back Pay Interest Lawsuit Thrown Out

Home Depot U.S.A. Inc. defeated a lawsuit alleging it listed interest for workers’ back pay from an earlier case on the wrong tax forms, which the plaintiff said led to improper withholding.

The federal false-information statute at issue allows people to sue “only when a defendant willfully files information returns that misrepresent the amount of payments made,” which isn’t what the workers alleged here, the US District Court for the District of Oregon said. The workers said Home Depot overdeducted their state income tax, but that claim also fails, the opinion said.
