Home Depot Beats Employee’s Personal Injury Negligence Claims

Home Depot USA Inc. won dismissal of negligence claims by an employee who suffered a hernia on the job while moving a water heater after the Southern District of Texas found the worker was engaged in a routine task that wasn’t unusually dangerous.

Under Texas law, an employer isn’t liable for negligence when an employee is injured while doing the same character of work he has always done and that other employees in other stores are required to do, the U.S. District Court for the Southern District of Texas said.
