Holidays don’t count against the job-protected time off employees receive under the Family Medical Leave Act when they use that leave for only part of the workweek, the US Department of Labor said.
“If a holiday occurs during an employee’s workweek, and the employee works for part of the week and uses FMLA leave for part of the week, the holiday does not reduce the amount of the employee’s FMLA leave entitlement unless the employee was required to report for work on the holiday,” Wage and Hour Division Principal Deputy Administrator Jessica Looman said in an opinion letter issued Tuesday. ...
