New York is claiming authority to oversee private-sector union elections and disputes whenever the National Labor Relations Board fails to do so, under legislation Gov. Kathy Hochul (D) signed into law.
The legislation (A 8590 / S 8034) declares private-sector employees to fall within the scope of the state’s Labor Relations Act, unless the NLRB “successfully asserts jurisdiction” via federal court order over “any employees, employer, trades, or industries.” It took effect immediately following Hochul’s signing on Sept. 5.
