A jury must decide whether Hanover Foods Corp. harassed, fired, and retaliated against a heterosexual employee because of his perceived failure to conform to male stereotypes, the Middle District of Pennsylvania ruled.
Tyler Bonson’s lawsuit alleged the discrimination was based on his “gender identity,” but his allegations that the bias stemmed from the way he dressed, smelled, and “kept himself” really asserts claims for illegal sex stereotyping, the court said Thursday.
