Interns for Hearst Corp. magazines, including Harper’s Bazaar, Seventeen, Esquire, and Cosmopolitan, aren’t employees entitled to wages, a federal appeals court ruled.
The interns received extensive photography training during their internships, which generally were arranged to fit academic calendars, the court said. These and other factors indicate a lower court correctly concluded they were the primary beneficiaries of the time they spent working for the company’s magazines, Judge Dennis Jacobs wrote for the U.S. Court of Appeals for the Second Circuit. Judges José A. Cabranes and Richard C. Wesley joined the opinion.
