Harassment or Protected Speech? Feds Still Trying to Thread Needle

The heads of two federal agencies are still talking about how to draw a line between workplace harassment and offensive conduct that’s protected by labor law, Equal Employment Opportunity Commission Acting Chair Victoria Lipnic (R) told Bloomberg Law.

Lipnic has reached out to National Labor Relations Board General Counsel Peter Robb to try to continue discussions that started before Robb joined the board in November, she said. An NLRB spokeswoman confirmed that Robb “is in talks” with Lipnic about the effort.
