EEOC, NLRB Weigh Harassment Gag Orders

The Equal Employment Opportunity Commission and the National Labor Relations Board have discussed possible guidance on when businesses can require that workplace harassment investigations stay confidential. The idea is to harmonize protections for harassment victims, witnesses, and accused harassers with the right of workers to discuss workplace issues on the job.

An EEOC task force said confidentiality (to the extent possible) is the best policy. But the NLRB in a 2015 decision said blanket gag orders run afoul of federal labor law. Chris Opfer will have the story.
