Halloween Sign Mandate for Sex Offenders Deemed Unconstitutional

A Missouri law that requires registered sex offenders to post a yard sign discouraging trick-or-treaters violates the First Amendment, but a trial court must consider a different form of relief for the man who successfully challenged the law, a federal appeals court panel ruled.

The sign requirement was properly deemed unconstitutional by the lower court, the US Court of Appeals for the Eighth Circuit said in a Friday opinion.
