H&M Gets Proposed Pay Delay Class Suit Tossed From Federal Court

A former H&M worker is unable to pursue her proposed class action over untimely wages in federal court since most of the parties are from New York.

Judge Laura Taylor Swain dismissed Victoria Ventura’s suit without prejudice Monday pursuant to the home state exception of the Class Action Fairness Act. The suit can’t continue in the US District Court for the Southern District of New York since more than two-thirds of the proposed class members are residents of New York and H&M Hennes & Mauritz LP is headquartered in the Empire State, Swain said.
