H-1B Visa Litigants Denied Restraining Order on Second Lottery

A federal judge denied a request by lawyers for more than 500 H-1B visa seekers to stop U.S. Citizenship and Immigration Services from accepting what the attorneys contend is a new wave of fraudulent applications.

USCIS, a part of the Department of Homeland Security, conducted a second H-1B visa lottery for the coming fiscal year last week after the attorneys had sued to halt the online registration process adopted earlier this year, claiming it was rife with fraud, and had filed papers asking U.S. District Judge Trevor McFadden in Washington for a preliminary injunction.
