Guidant Global Inc. convinced a Michigan federal judge to deny conditional certification of a Fair Labor Standards Act collective action brought by a former employee seeking unpaid overtime.
Although Chadwick Smith sufficiently proved that Guidant applied the same overtime policy and practice to him and other similarly situated workers, the case isn’t manageable as a nationwide collective action because of its size, Judge Gershwin A. Drain of the U.S. District Court for the Eastern District of Michigan said Thursday.
